Step #1: Notify your employer.

You are responsible for informing your employer of the accident. Your employer should ensure you receive the reasonable and necessary medical care following the accident. The timeline of these events is crucial when it comes to your health. In addition to ensuring you receive medical attention, your employer should provide you with fundamental accommodations for recovery, whether it be time off or workplace setting adjustments.

Step #2: File a workers’ comp claim.

In New Mexico, the majority of employers are required to have workers’ comp insurance with a few exceptions such as having less than three employees or employers with real estate salespeople or domestic servants. Your employer should inform you if they do not provide insurance. Filing a workers’ comp claim right away is important as you must notify your employer within 15 days and complete the Notice of Accident Form.      

Step #3: Document everything.

Be sure to take notes of everything that happened on the day of the accident to recent encounters. Keeping a journal with the names of witnesses, items present, medical visits, and other key information will be useful when it comes to providing a timeline of the incident. Most importantly, it will help piece the puzzle together.
